These Terms govern all custom manufacturing orders placed with Alexander DM Corp. ("ADM"). By signing a quote, submitting a deposit, or making any payment to ADM, you ("Client") agree to these Terms.
1. Custom, made-to-order work
Every piece ADM produces is made to order to the specifications set out in the Client's signed quote. Pieces are hand-fabricated and are not stock merchandise.
2. Quotes and pricing
Prices are based on the gold spot price at the time of quoting and may be adjusted at order confirmation.
Metal weights given in a quote are estimates only. The final price of an order may vary based on the actual gram weight of the finished piece, charged at the rate quoted. Any additional amount due must be settled before the order is released.
Shipping may be quoted and billed separately from the piece.
3. Deposits, balance, and how orders are billed
Production cannot start without both a signed quote and payment on file.
Each order is billed as two separate charges: a deposit to begin production, and a balance before shipment. These are two distinct transactions for two distinct stages of the same order and are not duplicate charges.
The remaining balance must be paid in full prior to pickup or shipment. No order is released until payment has been received and processed. ADM is not responsible for delays caused by an outstanding balance.
4. Specification approval
Production begins only after the Client has signed and approved the written specifications, which include metal, finish, estimated gram weight, and all stone types, sizes and dimensions.
Where a CAD rendering or design proof is provided, the Client's written approval of that rendering forms part of the approved specification.
Verbal or telephone approvals are not accepted. Only written, signed approval constitutes acceptance of a specification.
5. Manufacturing tolerances
Hand-fabricated jewelry cannot be produced to an exact weight or dimension. The following variances are within specification and do not constitute a defect or a piece "not as described":
- Gram weight: ±10%, or ±1.0 grams, whichever is greater
- Dimensions: ±1.00 mm on any stated measurement
Final price is adjusted to actual finished weight as set out in Section 2.
6. Client-supplied stones
Where the Client supplies a center stone or accent stones, the setting is manufactured to the stone dimensions provided by the Client.
ADM does not receive, measure or verify the physical stone against the dimensions supplied. If the stone provided differs from the dimensions given, any resulting fit or setting issue is not a manufacturing defect and is not covered by Section 9.
7. Production time
Standard production time is 4 to 8 weeks from the later of (a) the Client's signed specification approval and (b) cleared deposit payment.
This period is paused for any period during which ADM is awaiting Client-supplied stones, requested design revisions, or a response to a request for approval.
8. Shipping and delivery
Orders ship only to the delivery address provided by the Client at checkout. Any change of delivery address must be submitted in writing by the cardholder or account holder prior to shipment.
All shipments are sent signature-required. Delivery is complete, and risk of loss passes to the Client, upon signature at the delivery address.
9. Inspection, acceptance, and remedy
The Client must inspect the piece immediately on receipt.
Visible damage, shortage, or a wrong item must be reported in writing within 48 hours of delivery, with photographs.
Any claim that the piece does not conform to the approved specifications must be reported in writing within 5 business days of delivery. After that period the piece is deemed accepted.
A claim under this Section is valid only if the piece is returned unaltered and unworn. Where a claim concerns gram weight or dimensions, the measurement taken by ADM on the returned piece governs; measurements taken by the Client or by any third party are not determinative.
Where a piece is reported within the applicable period and ADM finds that it does not conform to the approved specifications, the Client's sole and exclusive remedy is repair or remake by ADM at no charge, provided the piece is returned to ADM unaltered within that period.
10. Third-party work voids remedy
Any setting, sizing, polishing, engraving, repair or alteration — or any attempt at any of these — performed by anyone other than ADM voids all warranty and remake rights under Section 9, and constitutes acceptance of the piece as delivered. This includes any attempt to set a stone into the piece.
11. Refunds and cancellation
Custom orders are non-refundable. All payments are non-refundable, including both deposits and balance payments. In exceptional circumstances, ADM may issue account credit at its sole discretion.
In the event of cancellation, the deposit is forfeited. Deposits cover labor, materials and production costs already committed.
12. Limitation of liability
ADM's liability for any claim arising from its products or services shall not exceed the total amount paid by the Client for the order concerned. ADM is not liable for indirect, incidental or consequential loss, including lost profits or lost sales.
13. Governing law
This agreement is governed by the laws of the State of California. Any dispute shall be resolved exclusively in Santa Clara County, California.
14. Acceptance of these Terms
By signing a quote, submitting a deposit, or making any payment to ADM, the Client acknowledges having read and agreed to these Terms.
